This agreement establishes the terms that will govern the legal relationship between the site napiyor.com and its users.

 

Digitiy Napiyor ziyaretçilerine Mikro Blog hizmetleri sunar. Digitiy Napiyor, Özel ve Tüzel kişiler KULLANICI olarak anılacaktır.



Digitiy Napiyor'a üye olabilmek için üyelik formunun eksiksiz doldurulması gerekir. Bu forma aktarılan bilgilerin doğruluğunu, üyelik isteğinde bulunan KULLANICI taahhüt eder. Bu iş durumunda, Üyelik Sözleşmesi (bundan böyle SÖZLEŞME olarak anılacaktır), Çağan Erdil (bundan böyle Napiyor olarak anılacaktır) Digitiy Napiyor' un bütün yayın ve hizmet biriminden yararlanmakla, SÖZLEŞME maddelerini kabul etmiş olursunuz.

Mikro Blog yazarken Bir defa doldurulması gereken, Üyelik formuna bilgi girişi yaparken, bilgi formunda istenilen hususların eksiksiz ve açık doldurulması gerekir.

Üyelik internet ortamında oluştuğu için, kullanıcının üyelik başvurusu’nun tamamlanması, başvurunun da aynı düzeyde, Napiyor tarafından kabulü ile ŞÖZLEŞME ye teşekkül etmiş olur. Napiyor, SÖZLEŞME'yi tek taraflı olarak değiştirme ya da tadil etme hakkına sahiptir. Karşılıklı hak ve yükümlülükler başvurunun kabulü ile yürürlüğe girer.

 

Napiyor siyasi amaçlı veya başkalarına saldırı amaçlı kullanılamaz.Yasalara aykırı ve genel ahlak prensibine uygun olmayan kişisel kimliklere saldırı mahiyetinde ilan verilemez. Yasalara göre, suç sayılan bir eylem aracı olarak Napiyor girdileri kullanıldığı zaman yasal mercilerden bir talep vuku bulursa, bu KULLANICI veya KULLANICILAR hakkında bilgiler gerekli yerlere istem doğrultusunda verilecektir.

Napiyor tüm KULLANICILARIN kişilik haklarına, gizlilik haklarına saygı duymaktadır. Yazılı sebepler dışında ve yargı mercileri istemi haricinde her ne sebeple olursa olsun, kişisel bilgileri hiçbir kurum veya kuruluşa vermeyeceğini kabul ve taahhüt eder.

Napiyor, hiçbir sebep beyan etmeden istediği KULLANICILARIN üyeliklerine son verme hak ve yetkisine sahiptir.Napiyor' in iptal ettiği veya üyelikleri sözleşme maddeleri gereğince iptal edilen kullanıcıların üyelik bilgileri Napiyor tarafından saklanacaktır.Üyelik sözleşme maddeleri gereğince iptal edilen KULLANICILAR dışında, üyeliklerini iptal eden KULLANICILAR, Napiyor' ye başvurma suretiyle üyeliklerine geri alabileceklerdir.

Napiyor, veri tabanına yapılabilecek saldırılar sonucu üyelik bilgilerinin kötü amaçlı kişilerin eline geçmesi ve bunların kötü niyetli kullanılması halinde doğabilecek sonuçlardan dolayı sorumluluk kabul etmez.

Digitiy Napiyor'un amacı, herkesin yazmasını sağlamak, bu hizmetten internet te herkesin faydalanmasını sağlamaktır. Gerek hizmetin arzı ve gerekse iletişim enstrümanları ve üyelerin girdileri yönünden Napiyor hiçbir sorumluluk kabul etmez. KULLANICILAR arasındaki hiçbir işlemde, Napiyor hukuki sorumluluk taşımaz.

Napiyor, www.Digitiy Napiyor üzerinde hileli, yanıltmaya yönelik, eksik ve/veya yanlış beyanda bulunan ve/veya herhangi bir ilan işlemi gerçekleştiren KULLANICILAR'ın tek taraflı olarak herhangi bir onay gerektirmeden ve önceden uyarıda bulunmadan geçici ve/veya süresiz olarak üyeliklerini sonlandırma hakkına haizdir.

Her türlü kullanım ve yazılımlarda telif hakları ve eser haklarına tecavüz edilmeyecektir. Her türlü telif hakkı ve insan hakları sorumluluğu üyeye aittir. Bu sebeple Napiyor' ye rücu kesinlikle mümkün değildir.

Napiyor üzerinden gerçekleşen işlemler ile, Napiyor'un doğrudan veya dolaylı olarak herhangi bir bağlantısı olmamasından mütevellit, KULLANICILAR, Napiyor'daki işlemlerden dolayı ortaya çıkabilecek her türlü anlaşmazlıklar ve bu anlaşmazlıkların yaratacağı her türlü iddia, talep veya hasar beyanlarından, Napiyor'un sahiplerini, temsilcilerini ve/veya çalışanlarını sorumlu tutmamayı, tazminat talep etmemeyi ve üçüncü kişi ve kurumlar tarafından kendisine yöneltilecek her türlü talepten muaf tutmayı bu SÖZLEŞME'yi onaylayarak ve Napiyor'a üye olarak önceden kabul ve beyan eder.

Napiyor'un kontrolü dışında, internet kullanımında (elektrik kesintisi, donanım problemleri, altyapı sorunları, doğal afetler, vs. gibi) dolayı birçok sorunlar yaşanabilir. Bu ve bunun gibi sebeplerden, Napiyor hiçbir şekilde sürekli, kesintisiz ve güvenli hizmet vereceğini garanti veya taahhüt edemez.

Napiyor ve KULLANICI, hukuken tamamen bağımsız taraflardır. Bu iki bağımsız taraf arasında herhangi bir iş ortaklığı ve/veya işçi/işveren ilişkisi bulunmamaktadır.

Bu sözleşme her iki tarafı da bağlar. KULLANICILAR, Napiyor'ye üye olmak aracılığıyla bu SÖZLEŞME'nin tamamını okuduklarını, içeriğini tamamıyla anladıklarını ve tüm maddelerini kayıtsız şartsız kabul ettiklerini ve onayladıklarını peşinen kabül ederler.

Forum of Election

Any dispute concerning this Agreement or the site will be resolved in court in line with the Turkish law, leaving the main forum in the city of istanbul elected as the only competent to deal this issue.

 

Final Provisions

This Agreement shall be governed by the laws of Turkey and meet the Turkish legal system, the general principles of law and international standards for e-commerce.

If the user does not agree with certain provision of this Agreement, and get legal invalidity of the same, other devices will not be harmed and will remain in force.
